Ellice Tanner Hart Limited (ETH, we, us, our) is committed to ensuring your information, including personal information, is protected.
This privacy policy (Privacy Policy) explains how ETH collects, holds, uses, discloses, and protects your personal information, who we may disclose it to, and how you can correct or change it.
In this Privacy Policy:
‘personal information’ is as defined in the Privacy Act 2020 (Privacy Act);
‘services’ in this Privacy Policy, means the legal and advisory services ETH provides to you (and other clients) under our Terms of Engagement;
‘you’ refers to an identifiable individual, or a client, potential client, or representative of a client (as applicable).

1. APPLICATION OF THIS PRIVACY POLICY
1.1 This Privacy Policy applies to any personal information that you provide to ETH or authorise ETH to collect. Our Terms of Engagement and Terms of Use also provide more details.
1.2 By instructing ETH, continuing to work with ETH, and/or providing ETH with any personal information, you consent to ETH dealing with any personal information in accordance with and as set out in this Privacy Policy.
2. YOUR PERSONAL INFORMATION
2.1 The personal information ETH collects depends on the exact nature of our relationship with you and any services you use. For example, ETH may collect:
(a) identity and contact information, such as name, address, position, telephone number, e-mail address, and date of birth;
(b) information to enable us to comply with our obligations under anti-money laundering and countering financing of terrorism laws, including verifying your identity, and the identity of relevant persons in your organisation;
(c) written and verbal interactions with us, including instructions and meeting notes;
(d) any other information that you provide to us or authorise us to collect; and
(e) other personal information permitted or required by law in order to perform our professional services.
3. HOW ETH COLLECTS PERSONAL INFORMATION
3.2 ETH collects personal information directly from you and your representatives in several ways:
(a) as part of providing services to you, or through our other business dealings or interactions with you;
(b) when you share information with us for other reasons; and
(c) where you work with us and provide us with your information.
3.3 ETH may also collect personal information indirectly from a third party, if you have authorised the third party to provide us with, or authorised us to collect, the personal information. We may also collect publicly available information as part of our customer due diligence.
3.4 If you provide ETH with personal information about any individual other than yourself, you warrant and represent that you have obtained that person’s approval to provide their personal information, and have:
(a) provided them with a copy of (or otherwise referred them to) this Privacy Policy; and
(b) informed them that this Privacy Policy is the basis upon which ETH will collect, hold, use, and disclose their personal information.
4. HOW ETH USES YOUR PERSONAL INFORMATION
4.1 ETH may use your personal information in the following ways:
(a) providing our services and enabling us to work with you;
(b) complying with our legal obligations, including in relation to anti-money laundering and countering financing of terrorism legislation;
(c) where you specifically authorise that use or as permitted or required by applicable law; and
(d) any other purposes related to those outlined above, including any identity or credit checks, or as set out in our Terms of Engagement.
4.2 You are not required to provide ETH with any personal information that it requests. However, if you don’t provide ETH with personal information, or you ask ETH to stop using your personal information, this may prevent or hinder us from providing our services or otherwise engaging with you.
4.3 ETH may use generative artificial intelligence tools to help provide the services. Any use of such tools does not change ETH’s privacy obligations to you under this Privacy Policy and/or the Privacy Act. Where such tools are used, ETH will apply organisational and technical safeguards designed to protect your information. ETH does not use your personal information to train generative AI models.
5. DISCLOSURE OF PERSONAL INFORMATION
ETH may share personal information:
(a) to the extent reasonably necessary to provide services to you;
(b) where we engage third party service providers (including our technology providers), to the extent reasonably necessary for them to provide services to us;
(c) when specifically authorised by you (or your authorised representative); and
(d) as required by law, including where we are authorised or required to do so by the New Zealand Law Society's Rules of Professional Conduct.
6. STORAGE OF PERSONAL INFORMATION
ETH may store your personal information at our offices or with our service providers, which may include cloud services hosted in countries outside New Zealand. When ETH discloses personal information with a recipient outside New Zealand, we will ensure this disclosure is in accordance with the Privacy Act.
7. ACCESS TO AND CORRECTION OF PERSONAL INFORMATION
Under the Privacy Act, individuals have the right to access, and to request correction of, personal information we hold about them. If you want to make an information request, please refer to the ETH contact details below.
8. UPDATES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. Changes apply from the date the updated Privacy Policy is published on our website (or the date stated in the update) and apply to all personal information that we hold. If changes are material, we may also notify you directly.
